Multi-jurisdictional trusts litigation
I acted for two corporate trustees defending court proceedings in three jurisdictions (England, Bermuda and New York) over a number of years. My clients faced competing claims - running to several hundred million pounds - to the assets of BVI-law discretionary trusts.
The litigation was very active and my clients obtained a favourable judgment on preliminary issues and a dismissal of one set of the proceedings.
In addition to the litigation, my clients made several successful applications in the BVI for directions concerning the costs of the proceedings.
Most recently, I led the negotiations for my clients in respect of a global commercial settlement, which finally resolved the matter for them.
