I have practiced offshore (in Bermuda and in the BVI) for over 20 years. I have known and worked with Catherine Naylor throughout that time. Whilst 200 words might seem a generous number with which to provide a reference for her, it is difficult to avoid that reference being a long list of complimentary adjectives. I am always delighted to be engaged on a new project with Catherine: she is a team player who makes sure that those working with her are involved and engaged at every level; her leadership is quiet but determined, her style calm and utterly focused. All these skills were to the fore over an extended period, running into several years, in the complex international litigation flowing from the Madoff fraud in which I worked with her, over the whole of which period she demonstrated formidable focus and a sophisticated awareness of the interrelationships between different proceedings in various jurisdictions.

Multi-jurisdictional trusts litigation

I acted for two corporate trustees defending court proceedings in three jurisdictions (England, Bermuda and New York) over a number of years. My clients faced competing claims - running to several hundred million pounds - to the assets of BVI-law discretionary trusts.

The litigation was very active and my clients obtained a favourable judgment on preliminary issues and a dismissal of one set of the proceedings.

In addition to the litigation, my clients made several successful applications in the BVI for directions concerning the costs of the proceedings.

Most recently, I led the negotiations for my clients in respect of a global commercial settlement, which finally resolved the matter for them.
