Establishing a Cayman Island-based company within six weeks of being instructed
In a recent case, we assisted a HNWI to transfer his successful and long-established business to the Cayman Islands for estate planning, operational and asset protection purposes. New entities were established under a Cayman STAR Trust for a purpose in perpetuity with JP Integra acting as trustee. The settlor also agreed to appoint an additional director (provided by JP Integra) to the board of the newly formed Cayman Company.
The new director is an experienced accountant and trust administrator and has a substantial role in the operations of the business. At company level, in addition to providing a director to serve on the board of the company, work as an accountant and perform an administrative role, JP Integra assists a long-serving director of the client’s business to continue in his role in the business while living and working in the Cayman Islands.
The JP Integra Private Client team managed the process to establish the company, arrange for key contractual agreements to be drafted or redrafted to Cayman Law, open bank accounts with a prime bank in the Cayman Islands and liaise with a top tier Cayman law firm in respect of the preparation of the trust deed, all within six weeks of being instructed. The service from the JP Integra Private Client team enabled the client to complete the complete relocation of assets and liabilities of the original company. The work involved the project management of complex, multi-faceted legal work on a tight deadline and, in so doing, protected the client’s business, reduced costs and, working with the flexible enforcer provisions of the STAR trust regime, assisted the settlor to appoint an enforcer so that the interests of the settlor’s family are protected and compliant in the long term.
