Dispute relating to a Jersey Charitable Trust

My recent work includes acting for a retired trustee of a charitable trust in circumstances where it was inter alia claimed in proceedings brought by representatives of the Estate of X that (a) the trust was either invalid or a sham, (b) that the trust assets (alleged to be worth £40 million) were accordingly held on a resulting trust for the Estate of X and (c) that the subsequent appointment of the assets of the charitable trust to a Panamanian Foundation should be set aside and amounted to a fraudulent breach of trust. The case was interesting because it involved (a) a fact pattern spanning many years, (b) topical trust issues (sham) and (c) the representatives of the Estate of X having to make out their case of a mutual shamming intention in circumstances where their key witness was dead.
