International trusts for multi-jurisdictional family /USA estate matters

On recommendation from a third party, Jane was approached by a wealthy Channel Island family with children and grandchildren in the UK, New Zealand, USA and the Channel Islands, to take responsibility for their income tax affairs worldwide. Following a detailed review of their financial affairs it became apparent that they were unnecessarily exposed to estate duties and similar levies in a number of different countries. Jane was instrumental in obtaining and co-ordinating provision of detailed advice in all of the countries involved and worked closely with the family as they embarked on a prolonged and difficult process to streamline their affairs and take control of assets in the USA, the Netherlands, Germany, UK and elsewhere.

Unfortunately, one member of the family passed away after instructions had been given to transfer assets physically sited in the USA, but before those charged with custody had taken any action to comply with these instructions. This led to a six-year battle with the US authorities and the custodian banks to agree that the assets should not be subject to US estate duty before assets could be removed from the jurisdiction and enjoyed by the family once more. Jane co-ordinated the legal and tax advice on both sides of the Atlantic and built a close relationship with the family, and their legal and investment advisers to create and then manage family trusts fit for purpose in a number of different countries to hold assets for the long-term enjoyment of the family.
