Acting for a UK-domiciled settlor to successfully set aside transactions carried out by the trustee
Advising a settlor/beneficiary of Guernsey law trusts on an application to the Royal Court to undo transactions entered into by the trustee in breach of trust and which had disastrous UK tax consequences. Together with the client and their onshore-based advisers we carried out substantial investigations into the trustee's actions and also prepared detailed affidavit evidence, pleadings and legal submissions to achieve a landmark outcome.
Acting for an institutional trustee in a complex breach of trust claim
Acting as offshore counsel for a Swiss-based trustee of a Guernsey law trust including for directions whether or not the trustee should involve itself in litigation as part of a wider multi-jurisdictional dispute. Appearing before the Royal Court at various stages in the litigation, advising as to Guernsey law civil procedure and litigation strategy and working closely with leading counsel on novel trust and company law principles.
Acting for a beneficiary in a trust restructure blessed by the Court
Advising a beneficiary of Guernsey law dynastic family trusts in relation to a tax-efficient restructuring and the distribution of assets. The beneficiaries were living in different parts of the world including Australia, Asia, Europe and North America each with distinct personal and tax considerations to be accounted for. Bespoke arrangements were implemented for each of the family branches and ultimately blessed by the Royal Court as a momentous decision.
