Acting for a wife in divorce proceedings with net assets of £23 million
Acting for a wife in divorce proceedings with net assets of £23 million. The husband and wife jointly owned a multi-million-pound business, which the wife wanted to retain. Katy successfully negotiated a settlement which meant the husband resigned and the wife was able to retain the company.
Removing children from jurisdiction
Successfully defending a mother’s application to permanently remove the children from the jurisdiction and securing a shared residence arrangement for the father.
Acting for a client in financial remedy proceedings
The client has a significant shareholding in the family business valued in excess of £4 million together with substantial pension assets of £1 million and property assets of £2 million. The client's main objective was to protect the family business from any claim by their ex-spouse who had retired from the business and sold their shareholding 18 months earlier. My client's ex-spouse had subsequently moved their residence and asset base abroad.
A key issue throughout proceedings was the other party's non-engagement and failure to provide full and frank disclosure, made more complex by the fact that the other party resides abroad. As a result of the other party's failure to engage in the court process, we had to obtain two penal notices during the course of proceedings, with one resulting in committal proceedings. Other complex issues included the instruction of an expert valuer to value two overseas properties and international tax issues.
We were successful in securing substantial orders against the other party for payment of our client’s legal costs as a result of thier litigation misconduct and, ultimately, we were able to secure a settlement which protected the family business and left our client with the lion’s share of the UK property assets.
We were able to handle this matter because of our pre-existing relationship with the company that gave us in depth knowledge of the company and a high degree of trust with the client who trusted our insight as to case strategy.
Acting in a children act dispute
Acting in a children act dispute where there have been very serious allegations of sexual abuse. The case has required swift, empathetic and expert handling. I have also had to be mindful of the ongoing police investigation to be sure that we do not prejudice their investigations.
