Obtaining court sanction for the appointment of trust property onto a new settlement

This matter involved obtaining court sanction for the appointment of trust property onto a new settlement upon modernised terms, and for the purposes of a distribution to a philanthropic foundation. It is made pursuant to the jurisdiction provided for in public trustee v. Cooper which states that the Court can approve momentous decisions by trustees.

I was counsel for the trustee in making the application in the Supreme Court for sanction to make such appointments and to appear on the hearing of the application. The assets held in the trusts were valued at more than $1 billion.
