Client work includes:
- Advising trustees on a highly complicated matter involving a deemed economic settlor having undergone a voluntary disclosure program in South Africa in connection with sums transferred into trust in breach of South African exchange control regulations and without paying the necessary taxes on those transfers. This matter involves a multitude of issues, including capacity issues, appointments of new protectors being challenged and beneficiaries in 4 different countries also undertaking voluntary disclosure programs.
- Advising co-trustees on restructuring a Jersey trust structure which holds a trading business valued in excess of £1bn during a period of time when there were divorce proceedings on-going in Italy between a beneficiary and his wife. Matters of Italian law were relevant when determining whether or not to restructure.
- Advising a former qualified member of a Jersey foundation on whether or not their resignation was effective in light of the newly appointed qualified member subsequently denying its appointment and the newly appointed qualified member not having registered the change of qualified member with the local registrar, which is a requirement under the law.
- Advising a corporate services provider on legal and regulatory requirements when establishing a Jersey private trust company structure.
