Restructuring ultra-high net worth family wealth
Advising on restructure of ultra-high net worth family wealth held partly in trust and partly individually. The restructure was very complex and included updating and harmonising existing trust deeds and creating a new purpose trust and private trust company and other corporate structure to carry out philanthropic activities for the family going forwards. The matter was cross jurisdictional and included consideration of issues relating to different groups of beneficiaries and excluded persons and mechanisms to transfer funds out of existing personal ownership into trust. The restructure involved innovative drafting to attain the required result from a succession perspective but providing reassurance to the family that they retained an element of control.
Advising on trusts being moved from Cayman to Jersey
Advising on series of trusts being moved from Cayman to Jersey where there was argument about the extent of the Settlor's reserved powers and therefore the validity of the trusts. These trusts were very high value and the whole structure needed resettling and amending.
